Sadly, the state violates its own Constitution when it requires the License to Carry Firearms (LTCF). And the new "standardization committee" is a joke. The process is already standardized…but we have rogue sheriffs all over the state who simply do what they want, including lying about the usefulness of the LTCF and the laws regarding carrying a firearm.
There are several counties who follow the law – and obtaining an LTCF takes only 10 minutes. There are several other counties that take up to the 45-day max…and some counties that illegally go beyond that. Unfortunately, you can only go to your home county.
On top of that, the PSP is continuing to add to its illegal gun registration that they handily call a "sales database."
But Tom Corbett is too busy campaigning to notice…
A while back I checked with the sheriff's office here in Bradford County about carrying a side arm. I was told you need a permit in Pennsylvania to carry a concealed weapon. However, (and it sounds crazy) if you carry in the open you are NOT required to have a permit and you don't need a permit in Pennsylvania to buy a side arm, just pass the background check.
Open carry is legal in PA. No LTCF is required. It is required for concealed carry and transport (among other things).
So, yes, you can walk down the street with a sidearm exposed without any legal violations. And last year's MPOETC training update made it very clear to law enforcement that it is legal and that stopping citizens and "asking for papers" is improper.
"just pass the background check" should be all that's necessary in this day and age…
Seriously, we live in a high speed computerized era where you just about think a complete thought and it's already done. Government should be no more intrusive than it should be and certainly no more intrusive than the constitution allows. Here, run the name, address and other identifying information through a database – check: federal, state, mental health, PFA's, juvenile records and military databases – and compare the individual against some basic brightline rules.
Bang – background check done in 20 seconds. Once and done – here's your gun (or carry permit).
I agree. Some politicians just don't understand that millions of armed Pennsylvanians didn't kill anyone today, yesterday, etc.
absolutely correct. Law abiding citizens aren't killing and robbing people. Criminals don't buy weapons legally. So it's just another source of revenue for government from hardworking, law abiding citizens. More money they get to waste.
On a side note, kudos to you Chris for picking a Magnum Research Baby Eagle/Jericho 9mm for the image.
I've had the pleasure of shooting one chambered in .40 S&W and it was a marvelous piece of machinery.
